Warranty Coverage for Progress Lighting Products

Coleto Brands warrants all its products to be free from defects in design, material, and workmanship, under normal use and subject to certain conditions and exclusions. The warranty set forth herein only covers products purchased directly from Coleto Brands or its authorized dealers. Warranty coverage starts from the date the product was received by the original end-use purchaser or their authorized representative (Contractor etc.). The limited warranty may not be assigned or transferred by the end purchaser. A builder or contractor, who purchases and installs the fixtures in or on a new or remodeled property may transfer the limited warranty (with the applicable remaining warranty period) to the then-current owner or end purchaser.

Exclusive Remedies

The warranty terms contained herein shall be the only warranties provided by Coleto with respect to the provider and shall be the sole and exclusive remedy of the purchaser of Coleto Brands’ products and Coleto Brands entire liability and obligation to such purchaser. EXCEPT FOR THE WARRANTIES SET FORTH IN THIS DOCUMENT, COLETO BRANDS PROVIDES NO FURTHER WARRANTIES, EXPRESSED OR IMPLIED, WITH RESPECT TO THE PRODUCTS AND EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Coleto Brands, at its sole discretion, will repair or replace, free of charge, any product or component part (as described above) that proves defective (as determined by Coleto Brands in its reasonable discretion) in material and/or workmanship under normal installation, use and service during the applicable warranty period. If repair or replacement is not practical, Coleto Brands may elect, in its sole discretion, to refund the purchase price in exchange for the return of the product. Replacement parts are subject to availability and may differ from those originally supplied. Any product or component part repaired or replaced pursuant to the terms of this warranty will be warranted for the remainder of the original warranty period applicable to such product or component part, plus an extension for the period of time that the product was out of service for repair or replacement.

This warranty excludes labor and equipment required to remove and/or reinstall original or replacement parts. This warranty gives the end user customer specific legal rights, which vary from state to state and province to province. No distributor, salesperson, dealer, retailer, or other representative has the authority to change or modify this warranty, either orally or in writing, in any respect. WARRANTY IS VOID IF PRODUCT IS NOT USED FOR THE PURPOSE FOR WHICH THIS PRODUCT IS DESIGNED, IS STORED OR TRANSPORTED IMPROPERLY, OR IS MODIFIED BY ANY PERSON OTHER THAN A COLETO BRANDS AUTHORIZED SERVICER. THE REMEDIES DESCRIBED HEREIN ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND COLETO’S ENTIRE LIABILITY FOR ANY BREACH OF THIS WARRANTY. COLETO’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL COLETO UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

Warranty Exclusions

Finish Variation: Finishes made by Coleto Brands are artisan finishes. One should expect minimal variations in finish between fixtures. This variation is not deemed as a defect and would not be covered under warranty.

Finish Warranty Exclusions:

• Outdoor Finishes: Outdoor fixtures experience prolonged exposure to outdoor elements such as sunlight, pollutants, humidity, and other environmental conditions. Certain outdoor finishes will naturally age over time, changing appearance. Finishes on outdoor fixtures may naturally fade over time but will not affect the operation of the product. Any warranty claims pertaining to fading, discoloration or patina of finish would not be covered.
• Certain Environments: The environment within a 10-mile radius of a body of water is highly corrosive. Due to this severity, products will naturally deteriorate faster than in other locations, even with appropriate maintenance. This expected corrosion and deterioration is considered normal wear and tear for this environment, and as such, any claims for finish failures or corrosion of other components resulting from coastal conditions are not covered by the aforementioned warranties. We offer coastal rated fixtures such as LifeBrite™, Climates™ and Durashield™, that are designed to operate better than our more typical products in this environment.
• Chemicals and Harsh Cleaners: Finishes exposed to chemical or abrasive cleaning products or methods would not be covered by our warranty.

Glass Variation: Each glass component is custom made and may contain bubbles. A non-uniform distribution of seeds in seeded glass is to be expected. These reflect custom craftsmanship. These aesthetic attributes are not considered a defect and are not covered by warranty.

Wind Damage: Hanging fixtures such as pendants and chandeliers should not be hung in areas of high winds (Sustained winds ≥40mph or gusts ≥58mph). Fixtures damaged due to high winds are not covered by warranty.

This limited warranty does not apply to improper function, loss or damage caused by:

• Use in environments for which the product was not designed or intended to be installed.
• Negligence, Abuse; misuse; mishandling; storage, or maintenance.
• Damage due to fire or acts of God or Nature; vandalism; civil disturbances.
• Power surges; improper power supply; electrical current fluctuations.
• Improper Installations: Certain fixtures such as chain hung pendants and chandeliers etc., would require adjustments to ensure leveling of fixtures. Any claims due to improper installation and or failure to follow installation instructions would not be covered under warranty. Use of aftermarket or other alternative components for installation would void the warranty.
• Used with aftermarket accessories such as incompatible motion sensors, dimmers etc.
• Alteration; Accident; failure to follow operating, maintenance or environmental instructions.
• Voltage outside of the North American Voltage Range 108 to 132 VAC (60HZ) and power surges

Key Definitions

Brand: Refers to the respective brand name under which the product is manufactured, marketed, and sold.

Application: Refers to the intended usage application of the fixture. Residential and Commercial applications have inherently different usage assumptions that will affect the longevity and performance of the product which are reflected in our respective warranty period commitments. Commercial applications are defined as installation within a commercially focused property where the product is assumed to be subjected to 12 hours of operation per day or greater.

Fixture and Finish: All components of the product (excluding packaging) not specifically addressed by a separate component warranty call-out, including any exposed surface finishes, sockets, and wire.

LED Light Engine: Includes Integrated PCBA light engine subassemblies as well as LED drivers, excludes any other electricals such as wire or sockets (covered under Fixture and Finish warranties). Does not include LED Light bulbs included as an accessory.

Fan Motor: Motor subassembly excluding exterior housings.

Durashield™, Weather+™: Specific finishes offered with extended warranties intended for outdoor, coastal applications within a 10-mile radius of the shore of a body of water. Warranties stated apply only to exposed surface finishes. Please refer to Warranty Exclusions above for more information on coastal environments.
